Last updated: November 28, 2025These Terms and Conditions of Use (these "Terms") are between you (also referred to herein as "user", "you" and "your") and Obsidia UG (haftungsbeschränkt), a company incorporated in Dortmund, Germany ("Obsidia", "we", "us" and "our"). These Terms govern your use of the products and services provided by Obsidia, specifically the Xnap MetaMask Snap (the "Snap") and the services made available on our website https://xnap.xyz/ (the "Website") (collectively, the "Services"). By accessing our Website and/or installing and using the Snap, you agree that you have read, understand, and accept all of the terms and conditions contained in these Terms.
1. Introduction
1.1 Eligibility
To be eligible to use the Services, you must (a) be at least eighteen (18) years of age or older; and (b) not be a Restricted Person.
A "Restricted Person" is any person that is subject to sanctions enforced by the United States, the United Kingdom, the European Union, or the United Nations, or is located in a country subject to comprehensive sanctions.
1.2 The Service
Xnap is a self-custodial software integration ("Snap") for MetaMask. It allows users to manage Nano (XNO) keys derived from their existing MetaMask secret recovery phrase. Xnap does not have access to your private keys, secret recovery phrases, or funds.
2. Conditions of Use
2.1 Non-Custodial Nature
Xnap is purely non-custodial software. You remain in full control of your digital assets, which are not held or controlled in any way by Obsidia. We do not collect or hold your private keys or your recovery phrase. You are solely responsible for the safety of your digital assets and for storing, backing up, and maintaining the confidentiality of your recovery phrases.
Obsidia cannot access your digital assets or recover keys. If you lose your MetaMask recovery phrase, you will lose access to your Nano managed via Xnap.
2.2 No Banking or Financial Services
Obsidia is a software provider. We do not provide banking, exchange, custodial, or financial services. Xnap is a tool for you to interact with the Nano network directly. We are not a regulated financial institution.
2.3 No Staking or Rewards
Xnap does not offer staking, yield farming, or rewards programs. Any references to such features in third-party materials do not apply to Xnap.
2.4 Fees
The Nano network is feeless (zero transaction fees). Obsidia does not charge any fees for downloading or using Xnap. You are responsible for any fees charged by third-party services or networks you interact with.
2.5 Prohibited Activities
You agree not to use the Services for any unlawful purpose, including but not limited to money laundering, terrorist financing, fraud, or violating sanctions. You agree not to interfere with or disrupt the Services or servers or networks connected to the Services.
3. Data Protection and Privacy
We do not collect personal information. Xnap runs locally in your MetaMask environment. We do not track your transaction history, balances, or IP addresses in a way that identifies you personally. Any analytics on the Website are privacy-preserving. We do not sell user data.
4. Risk Factors
You acknowledge that using digital assets and managing private keys involves risks, including but not limited to:
- Software Bugs: Xnap is software and may contain bugs or vulnerabilities. While we strive for security, we cannot guarantee it is error-free.
- Regulatory Uncertainty: Crypto regulations vary by jurisdiction and may change, potentially affecting the availability of the Services.
- User Error: You are responsible for your actions, including verifying addresses and managing your security. Transactions on the Nano network are irreversible.
- Third-Party Risk: Xnap relies on the MetaMask platform. Changes to MetaMask could affect Xnap's functionality. We are not responsible for MetaMask or the Nano network.
5. Intellectual Property
Xnap is open-source software. However, the "Xnap" name, logo, and website content are the property of Obsidia or its licensors and may not be used without permission except as permitted by applicable law or the relevant open-source license.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Obsidia and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services; or (c) unauthorized access, use, or alteration of your transmissions or content.
Our total liability for any claim arising out of or relating to these Terms or the Services is limited to the amount you paid us to use the Services (which is generally zero) or 100 Euro, whichever is greater. Nothing in these Terms excludes liability for intent or gross negligence or for damages resulting from injury to life, body, or health.
7. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. The exclusive venue for any disputes arising out of or relating to these Terms shall be the competent courts located in Dortmund, Germany, to the extent legally permitted.
